Terms of Use

By using the website publictender.mt and the “Procurement Monitor” service operated by
Közbeszerzés Figyelő Ltd. (hereinafter referred to as the Provider),
you as a User accept the following Terms of Use.


1. The Service Provided

The Procurement Monitor service allows Users to monitor public procurement notices published on
Tender Electronic Daily (TED) and other relevant Maltese and European Union procurement sources.

Based on the User’s search settings, the system continuously scans newly published procurement notices
and sends email notifications containing direct links to relevant public tenders.

Users may also search previously published procurement notices through the online platform.

The Provider does not host or publish tender notices itself. The platform only provides links to
official procurement sources.

3. General Terms of Use

3.1 After registration, Users may define keywords, sectors, CPV codes, or countries of interest via the
administration interface.

3.2 The system sends email alerts containing links to public procurement notices matching the User’s search settings.

3.3 Notifications are sent only when new tenders matching the specified search criteria are detected.

3.4 Tender identification is performed using automated algorithms. The Provider does not guarantee the
completeness, relevance, or accuracy of the results.

3.5 The Provider may use anonymized and aggregated usage data for statistical and analytical purposes.

3.6 The Provider reserves the right to refuse or suspend service if misuse, abuse, or unlawful activity is suspected.

3.7 The Provider does not guarantee uninterrupted service availability. Temporary interruptions may occur
due to maintenance or technical reasons.

3.8 The service is intended exclusively for the registered User.

3.9 Organizational accounts may register up to three additional internal users (email addresses), who must
be employees or internal members of the organization.

3.10 Individual Users may register only their own email address(es).

3.11 Redistribution, resale, or forwarding of the service or automated notifications to third parties is prohibited.

3.12 Violation of these rules may result in immediate termination of access and the User may be held liable
for damages.


4. Registration

4.1 Registration is required to use the service. Users must provide accurate and truthful information.

4.2 Legal entities may be required to provide the following information during registration:

  • User email address
  • Company name
  • Company billing address
  • Contact person name
  • Contact email address
  • Contact phone number
  • Business activity area

4.3 During registration the User must select at least one “business profile” representing the area of
interest related to public procurement.

4.4 By registering, the User consents to the storage and processing of the provided data, including the
IP address used during registration.

4.5 The agreement concluded during registration does not constitute a written contract and is not stored
separately by the Provider.


5. Free Access to the Service

5.1 The Procurement Monitor service is currently provided free of charge.

5.2 The Provider grants Users the right to use the service for an indefinite period of time.

5.3 The Provider reserves the right to introduce paid features, subscription plans, or modify access
conditions in the future. Users will be informed in advance of any such changes.


6. Contract Duration and Termination

6.1 The agreement between the User and the Provider is concluded for an indefinite period.

6.2 The User may stop using the service or delete their account at any time.

6.3 The Provider may suspend or terminate access immediately if the User violates these Terms of Use or
misuses the service.


7. Responsibility for Content

7.1 The Provider does not create, modify, or control the tender notices accessible through the platform.

7.2 The service acts solely as a search and monitoring tool providing links to official procurement sources.

7.3 The Provider assumes no responsibility for the accuracy, validity, or availability of third-party content.


8. International Use

Due to the international nature of the platform, Users must comply with the laws applicable in their
country when using the service. Responsibility for such use lies entirely with the User.


9. User Data and Account Deletion

9.1 Users must update their personal data if changes occur.

9.2 Users are responsible for keeping their password secure.

9.3 If unauthorized access is suspected, the password must be changed immediately.

9.4 Users may delete their account at any time.

9.5 Personal data will be deleted unless retention is required by law.

9.6 The Provider reserves the right to delete accounts in cases of misuse or violation of these Terms.


10. Data Protection

10.1 Personal data is processed in accordance with the European Union General Data Protection Regulation (GDPR).

10.2 Personal data is used solely for identification of the User, operation of the service, and statistical analysis.

10.3 Personal data will not be shared with third parties.

10.4 The Provider implements appropriate technical and organizational security measures to protect personal data.

11. Amendments to the Terms

11.1 The Provider reserves the right to modify these Terms of Use.

11.2 Users will be informed in advance about any significant changes.

11.3 Continued use of the service after publication of updated Terms constitutes acceptance of the changes.
